FDA and TGA Medical Device Pathways—What Sponsors Need to Plan Differently

FDA and TGA decisions may rely on overlapping technical and clinical evidence, but the pathways, terminology, legal roles, and application structures are not interchangeable. Sponsors reduce rework by planning one global evidence strategy with market-specific execution.

A sponsor entering both the United States and Australia should not begin by asking which regulator is easier. The more useful questions are: how is the device classified, what intended purpose and claims will be pursued, what evidence already exists, what new evidence is needed, and which legal entity will carry each market-specific responsibility?

Both systems are risk-based and both expect evidence that is appropriate to the device. The difference lies in how classification, conformity, market authorization, clinical data, and sponsor responsibilities are assembled into the route to market.

Do not compare FDA and TGA as if they were equivalent submissions

FDA marketing pathways include exemptions from premarket review and submissions such as 510(k), De Novo classification requests, and Premarket Approval applications. An Investigational Device Exemption is a mechanism that permits certain investigational devices to be used in U.S. clinical studies; it is not itself a marketing authorization.

In Australia, a device generally must be included in the Australian Register of Therapeutic Goods before supply unless an exemption applies. The manufacturer needs appropriate conformity-assessment evidence, and an Australian sponsor applies for and maintains the ARTG inclusion. Device classification, intended purpose, conformity evidence, application audit requirements, and clinical evidence all influence the route.

The common FDA device pathways

510(k) premarket notification

A 510(k) is used when applicable to demonstrate that a new device is substantially equivalent to a legally marketed predicate. Some Class I and most Class II devices require a 510(k), while exemptions and limitations must be checked for the specific regulation and device. The evidence package depends on the comparison, technological characteristics, intended use, performance questions, and applicable guidance or standards.

De Novo classification request

De Novo provides a risk-based route to Class I or Class II classification for certain novel low-to-moderate-risk device types without a legally marketed predicate. A granted De Novo can establish a new classification regulation and may create a predicate for later 510(k) submissions.

Premarket Approval

PMA is the most stringent common device marketing submission and is generally associated with Class III devices. It requires valid scientific evidence providing reasonable assurance of safety and effectiveness for the intended use.

Investigational Device Exemption

For significant-risk device studies in the United States, an approved IDE and institutional review board approval are generally required before study initiation. Other study categories and exemptions can apply. Sponsors should separate the U.S. clinical-study authorization question from the later marketing-submission question while ensuring that the study is designed for the evidence the marketing pathway will need.

How the Australian pathway is assembled

Australia regulates devices against the Essential Principles and a risk-based classification system. Manufacturers select and apply the appropriate conformity-assessment procedure. Depending on the device and class, evidence may include a manufacturer's declaration, an appropriately certified quality management system, device-specific assessment, and evidence from the TGA, an Australian conformity-assessment body, or an eligible comparable overseas regulator or assessment body.

The existence of overseas certification does not make the Australian step automatic. The evidence must be suitable for the application, the Australian sponsor must hold or be able to access required information, and the TGA can select applications for audit or request additional evidence. Requirements can also differ by device type and classification.

Clinical evidence and overseas data

FDA can accept clinical data from investigations conducted outside the United States. For investigations beginning on or after 21 February 2019, FDA regulations require specified statements and supporting information addressing good clinical practice. The data still need to be credible and relevant to the application. For a PMA relying solely on foreign data, applicability to the U.S. population and medical practice is an explicit consideration.

This means that an Australian or multi-country study can contribute to a U.S. submission, but location alone does not guarantee acceptance or remove the need for U.S.-specific evidence. Sponsors should address population, practice patterns, standard of care, device training, endpoints, and data integrity early.

For Australia, the amount and type of clinical evidence depend on the device's risk, intended purpose, claims, available data, and applicable requirements. TGA guidance describes how manufacturers and sponsors can compile and present clinical evidence, while comparable overseas regulatory evidence may support aspects of conformity assessment where eligible. Clinical evidence and conformity evidence are related but not interchangeable concepts.

Sponsor and manufacturer roles differ

In the United States, the applicable submitter, applicant, manufacturer, and clinical-study sponsor roles depend on the submission and activity. A foreign manufacturer may also need a U.S. agent, and an IDE sponsor must be located in the United States.

In Australia, the sponsor is the person or company legally responsible for supplying the device in Australia. After ARTG inclusion, the sponsor has continuing responsibilities that can include adverse-incident and overseas-regulatory-action reporting, obtaining information from the manufacturer, maintaining distribution records, and supporting recalls and post-market activity. The manufacturer retains its own conformity, technical-documentation, quality, and lifecycle responsibilities.

A better global planning sequence

  • Define the intended purpose, indications, claims, users, use environment, and device configuration before comparing pathways.
  • Confirm classification and likely submission or inclusion route separately for each market.
  • Map technical, clinical, usability, quality, and post-market evidence into one global evidence inventory.
  • Identify which evidence can be reused, which needs market-specific justification, and which gaps require new work.
  • Engage the appropriate regulator or specialist adviser before a pivotal evidence decision becomes expensive to change.
  • Design non-U.S. clinical work with FDA acceptance, GCP, applicability, and inspection-readiness considerations in mind where U.S. use is intended.
  • Define the U.S. and Australian legal entities, local representatives, submission owners, and post-market responsibilities early.
  • Maintain separate market decision logs while controlling one authoritative product and evidence narrative.

Avoid false shortcuts

  • An FDA authorization does not automatically place a device on the ARTG.
  • TGA recognition of eligible overseas evidence does not remove Australian requirements or sponsor obligations.
  • A study conducted outside the United States is not automatically unsuitable for FDA—and is not automatically sufficient.
  • An IDE is not the FDA equivalent of an ARTG inclusion.
  • Generic claims that one regulator is always faster, more flexible, or more evidence-intensive are unreliable without the device, class, pathway, and evidence context.
